Adopting library policy protecting minors from harmful matter over the internet at libraries
I, SUE DAVIS, Clerk of the Board of Supervisors of the County of Kern, State of California, hereby certify that the following resolution, on motion of Supervisor Ashburn, seconded by Supervisor Perez, was duly and regularly adopted by the Board of Supervisors of the County of Kern at an official meeting thereof on the 30th day of July, 1996 by the following vote and that a copy of the resolution has been delivered to the Chairman of the Board of Supervisors.

Section 1. WHEREAS:
(a) This board is empowered under section 19160 of the California Education Code to make general rules and policies for the operation of the Kern County Public Library;
(b) There is in the Kern County Public Library system a number of computers on which the public, including minors, may access the Internet and obtain any and all information available on said system;
(c) Sexually explicit material, as defined in California Penal Code Section 313.1 (c), is accessible on the Internet to library patrons of all ages who know how to access such information and visual images;
(d) The display of such sexually explicit material in a Kern County public library is disruptive to library patrons of the community, not conducive to the legitimate educational goals of a public library, and inconsistent with the purposes and goals of the Kern County Library system;
(e) It is unlawful under California law to display to minors sexually explicit matter or harmful matter as defined in Penal Code Section 313.1 (c);
(f) Under present conditions at the Library, it is possible for minors to obtain harmful matter as defined in the Penal Code and for any patron to disrupt and disturb other patrons by exposing sexually explicit material on computer screens visible to all; and
(g) This Board is resolved to prevent disruption of the educational atmosphere of the public libraries in Kern County through display of sexually explicit material and to restrict access of minors to harmful matter over the Internet, to the maximum extent possible, consistent with constitutional principles and available technology.
Section 2. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Board of Supervisors of the County of Kern, State of California, as follows:
1. This Board hereby finds it has jurisdiction in this matter and that the above recitals are true.
2. This Board hereby declares that it is the policy of the Kern County Library, consistent with constitutional principles and to the maximum extent possible with available technology, to prevent disruption of the educational purpose and atmosphere of the public libraries of Kern County through the display of sexually explicit material and to restrict access by minors over the Internet at County public libraries to harmful material as defined in the California Penal Code.
3. The Clerk of this Board is directed to send copies of the Resolution to the Administrative Officer, the County Counsel and the Director of Libraries.
